By purchasing, using, or wearing any product sold by Jacketed LLC, you (“Customer” or “User”) acknowledge and agree to the terms set forth below.
2. Intended Use of Products
- All clothing and apparel sold by Jacketed LLC are designed exclusively for general fashion and everyday wear purposes.
- Our products are NOT designed, manufactured, or marketed for use in conjunction with firearms, ammunition, or any other weapons.
- The Company does not provide any protective, ballistic, or tactical functions, nor do our products meet any standards for body armor, bullet resistance, or other safety gear.
3. No Guarantee of Safety
Jacketed LLC makes no representation or warranty—express or implied—that any product will protect against injury, harm, or death caused by firearms, weapons, accidents, or any hazardous activities. Customers are solely responsible for the manner in which they use our products.
4. Assumption of Risk
By purchasing or using our products, the Customer assumes all risks associated with their use, including but not limited to injury, bodily harm, or death resulting from misuse, improper application, or use in dangerous situations.
5. Limitation of Liability
To the fullest extent permitted by law, Jacketed LLC, its owners, employees, affiliates, and representatives shall not be held liable for any claims, damages, injuries, or deaths arising out of or related to the use, misuse, or performance of any product. This limitation applies regardless of the legal theory under which such liability is asserted (including negligence, strict liability, or tort).
6. Allergic Reactions
Jacketed LLC uses various materials in its products, including but not limited to fabrics, dyes, and finishes. While we strive to use safe and commonly accepted materials, we cannot guarantee that any product will be free from allergens or irritants.
- Customers are responsible for reviewing product descriptions and materials prior to purchase.
- Jacketed LLC is not responsible for any allergic reactions, skin irritations, or related health issues that may result from wearing or coming into contact with our products.
- If you experience an allergic reaction, discontinue use immediately and consult a medical professional.
7. Indemnification
The Customer agrees to indemnify, defend, and hold harmless Jacketed LLC from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney’s fees) arising out of or related to:
(a) misuse of the product,
(b) violation of this Agreement, or
(c) use of the product in connection with firearms or weapons.
8. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles.
9. Acceptance of Terms
By purchasing, possessing, or using any Jacketed LLC product, you acknowledge that you have read, understood, and agree to this Disclaimer and Liability Waiver.
